Q.9, v.49 solidifies what we Moslems have pointed out that the wartime enslavement of the female captives doesn’t mean the rape at all. Certain Arab men make personal excuse to not go to war, that they may not be able to “control” their urge if going to battle and getting the female slaves.
If the wartime enslavement were to be sexual enjoyment of ravishing and deflowering all female captives, why would the men have feared of unleashing their biological urge?
Regarding the verse, “Draw me not into trial,” this means, “Do not trouble me with the sight of the women of Al-Asfar and their daughters, for I am tempted by women, that I might go out and commit a sin (Atham) with them”.
Tabari cited the arguments in which even the Arab themselves found that the Islamic treatment of the female slaves is much more progressive and much decent than that of the ancient paganism and Judaism.
In Judaism, a Jew is allowed to commit such a “sexual initiation” over his female slaves, that is regarded as a token that marks the ownership.
In paganism, a female slave is sexually abused by a group of men in turn (polyandry, gangrape, groupsex). The collective disgrace upon the female slaves is a “norm” throughout the ancient heathen cultures, from the Roman empire, the ancient Egypt, to Arabian pagans.
In Islam, there’s no sexual initiation, there’s no rape, there’s no orgy whatsoever allowed.
A Moslem has to marry his female slave by earning the mutual consent, along with the waiting period of purification, giving dowry, and witnesses.
Lev 27:8, in case of uncertainty and Market fluctuation, the price of slave is estimated by the priest who acts as the Slave middle-dealer or broker.
a father sells his wife, sons and daughter (Mt 18:25).
a father sells his daughter (Exo 21:7, Neh 5:5).
a widow’s children are sold to pay their father’s debt (2 Kgs 4:1).
a man sells himself (Lev 25:39, Lev 25:47).
a woman sells herself (Dt 15:12-13, Dt 15:17).
Price of slave.
Exo 21:32, 30 shekels was a standard price.
Lev 27:3-7, the price varied from 3 to 50 shekels depending on age and gender.
Lev 27:5, 20 shekels is the price set for a youth, as the sum paid for Joseph (Gen 37:28).
2 Macc 8:11, the price on the average is about 40 shekels.
