The Light

In the name of Allah, the Beneficent, the Merciful.

[24.1] (This is) a chapter which We have revealed and made obligatory and in which We have revealed clear communications that you may be mindful.
[24.2] (As for) the fornicatress and the fornicator, flog each of them, (giving) a hundred stripes, and let not pity for them detain you in the matter of obedience to Allah, if you believe in Allah and the last day, and let a party of believers witness their chastisement.
[24.3] The fornicator shall not marry any but a fornicatress or idolatress, and (as for) the fornicatress, none shall marry her but a fornicator or an idolater; and it is forbidden to the believers.
[24.4] And those who accuse free women then do not bring four witnesses, flog them, (giving) eighty stripes, and do not admit any evidence from them ever; and these it is that are the transgressors,

Hadith: 008.082.816 

“Narrated Ibn ‘Abbas

‘Umar said, “I am afraid that after a long time has passed, people may say, “We do not find the Verses of the Rajam (stoning to death) in the Holy Book,” and consequently they may go astray by leaving an obligation that Allah has revealed. Lo! I confirm that the penalty of Rajam be inflicted on him who commits illegal sexual intercourse, if he is already married and the crime is proved by witnesses or pregnancy or confession.” Sufyan added, “I have memorized this narration in this way.” ‘Umar added, “Surely Allah’s Apostle carried out the penalty of Rajam, and so did we after him.”

If the Quran contains the eternal words of Allah then these words must represent the eternal will of Allah. If Allah is immutable, which would be necessary if he is God, he does not change his mind about whether a moral human action is right or wrong and the just penalty to accord with it. This would also be an injustice to those who were punished unequally for the same offense would it not? His wisdom would also be questionable if this were the case.

Once Allah has sent the angel to recite he has no way of turning back by giving another recitation as the Quran would contain contradictory rulings on the same offense. So we see here that Mohammed is greater than Allah because he never needed to change anything he had done. He always got it right first time.

A curiosity here is that accusing a woman of sexual infidelity is only twenty lashes less worth of punishment than actually committing the act of fornication itself. Also the requirement for four witnesses who also had to be in the immediate presence as eye witnesses of all the details. This shows a strong emphasis in Islam on covering things up, if the perpetrators are Muslims, so that the Ummah does not come in to disrepute and by implication, Islam itself. This is more important than actually punishing the act itself. This is one reason why a lot of pressure is put on non-Muslims to settle out of court if they have a justifiable grievance against a Muslim.

    It is permitted though. It is necessary to make impression to sinners that Moslems are more judgmental than Allah. Per Q.59, v.13, Moslems and God of Islam are not always synonymous for Non-Moslems.
    In the sight of Non-Moslems, Moslems are more uncompromising, intolerable, frightful, agonizing than Allah. To forgive is divine, to err is human. To love is personal, to judge is political.

    In Islam there’s a well-known principle that is slightly similar to “the Law of the land” in the Christian theology, that is the ” Mu’ahid ” in light of Qur’an Q.4, v.90.
    Mu’ahid is a covenanted infidel, not a dhimmi under Islamic Shari’ah.
    Killing the infidels in warfare (Dar al-Harb) is obligatory, but the ruling is exempted and superseded by the covenant (Mithaqun) of respecting of the basic human Rights of Mu’ahid (life, faith, wife, wealth, feeling, border, et cetera) as long as their right doesn’t seek to enmity with Islamic belief.

    In today’s West, taking the female slaves, polygamy, marrying post-pubescent women below marriage age, collecting poll-tax, scourging the adulterer, jailing the apostates, making the religious political party, organising the faith-based militias, et cetera are crime. Moslems have to respect their law.

    Abu Dawud, Hadith 3052.
    Safwan reported Messenger of Allah said: Beware, if anyone wrongs a Contracting man, or diminishes his Right, or forces him to work beyond his capacity, or takes from him anything without his consent, I shall plead for him on the Day of Judgment.

    أَلاَ مَنْ ظَلَمَ مُعَاهِدًا أَوِ انْتَقَصَهُ أَوْ كَلَّفَهُ فَوْقَ طَاقَتِهِ أَوْ أَخَذَ مِنْهُ شَيْئًا بِغَيْرِ طِيبِ نَفْسٍ فَأَنَا حَجِيجُهُ يَوْمَ الْقِيَامَةِ ‏”‏ ‏.‏

    لَّا الَّذِينَ يَصِلُونَ إِلَىٰ قَوْمٍ بَيْنَكُمْ وَبَيْنَهُم مِّيثَاقٌ أَوْ جَاءُوكُمْ حَصِرَتْ صُدُورُهُمْ أَن يُقَاتِلُوكُمْ أَوْ يُقَاتِلُوا قَوْمَهُمْ ۚ وَلَوْ شَاءَ اللَّهُ لَسَلَّطَهُمْ عَلَيْكُمْ فَلَقَاتَلُوكُمْ ۚ فَإِنِ اعْتَزَلُوكُمْ فَلَمْ يُقَاتِلُوكُمْ وَأَلْقَوْا إِلَيْكُمُ السَّلَمَ فَمَا جَعَلَ اللَّهُ لَكُمْ عَلَيْهِمْ سَبِيلًا

    Q.4, v.90. Except those who join a nation between whom and ye there is a Covenant, or those who approach you with hearts restraining them from fighting you as well as fighting their own people. If Allah had pleased, He could have given them power over you, and they would have fought you: Therefore if they withdraw from you but fight you not, and instead send you the peace, then Allah hath not opened any way for you (to hurt them)

    Rajam is known as the additional penalty outside of Allah’s Book:
    Abi Dawud 4418.
    ‘Abd Allah b. ‘Abbas said: I swear by Allah, had it not been so that the people might say: ‘Umar made an addition to Allah’s Book, I would have written it (there).

    Half stoning, half death?
    Qur’anic verse Q.4, v.25 gives impossibility of a death sentence for the married slave who commits adultery. It talks about the punishment of a married slave (either male or female) to be “half” the punishment of a free married Moslem (either male or female). In this case, how much can a married slave be given a half of stoning?

    Biblical penalty for a virgin (unmarried) adulteress is a stoning. In Qur’an it is just the scourging in order to spare their (both male or bachelor, and female or virgin) life.
    Deut 22:24
    Then you shall take both of them to the gate of that town and stone them to death, the girl because she was in a town and did not scream for help, and the man because he violated another man’s wife. You must purge the evil from among you.

    Reluctance?
    As-Suyuti, Al-Itqan fii Ulum al-Qur’an, p.528
    Zaid ibn Thabit and Sa’id ibn al-As were writing out the mushaf and when they came to this verse Zaid said, “I heard the messenger of Allah say: ‘The adult men and women who commit adultery, stone them as a punishment”‘. Umar said, “When it was revealed I went to the Prophet and said, ‘Shall I write it?’, but he seemed very reluctant”.

    Where to put?
    After all, no one knows for sure where or on what number exactly the verse of Rajam (if it existed) should be placed on Qur’an.

    Fact: Rajam doesn’t always mean stoning to death in Qur’an.
    The Arabic word “Rajam” in Qur’an doesn’t have to mean the “killing” or stoning to death, at least as 2 verses mention:
    1. Q.19, v.46 (stoning is a step before fleeing away alive)
    2. Q.36, v.18 (stoning is a step before another physical torture alive).

    Fact: Rajam doesn’t always mean stoning to death in Hadith.
    According to Hadith, the stoning punishment – Rajam – can be aborted or forfeited if the adulterer managed to run away despite bleeding.
    The Hadith is authentic because it is supported by the Arabic word “Rajam” in Qur’an that also doesn’t mean the “killing” or stoning to death, as Q.19, v.46 (stoning is a step before fleeing away alive) and 2. Q.36, v.18 (stoning is a step before another physical torture alive).
    Abu Dawud, Book 39, Hadith 4405.
    Narrated Nu’aym ibn Huzzal: He was then taken out to the Harrah, and while he was being stoned he felt the effect of the stones and could not bear it and fled. But Abdullah ibn Unays encountered him when those who had been stoning him could not catch up with him. He threw the bone of a camel’s foreleg at him, which hit him and killed him. They then went to the Prophet and reported it to him. He said: Why did you not leave him alone. Perhaps he might have repented and been forgiven by Allah.

    Jami’ at-Tirmidhi, Vol. 3, Book 15, Hadith 1428.
    Narrated Abu Hurairah: He was taken to Al-Harrah and stoned with rocks, he ran swiftly until he passed a man with a camel whip who beat him with it, and the people beat him until he died. They mentioned to the Messenger of Allah, that he ran upon feeling the rocks at the time of death. So the Messenger of Allah said: ‘Why didn’t you leave him?’”

    At what age?
    The alleged Rajam verse is a myth because it is based on rumors that mention ambiguous term of the elder man (Shaikh) and elder woman (Shaikah), rather than the exact term “married ones”. What about a possibility of the elder people that never get married?

    One of the lovers has to be married or betrothed for adultery to be committed.

    If both are unmarried the “punishment” is marriage.

    A virgin girl shall be stoned to death if the case is related to the free sex by consent, not the rape.
